Lindsay Lohan's Warrant

The L.A. County District Attorney will decide this week whether Lindsay Lohan should be prosecuted for allegedly stealing a necklace from an L.A. jewelry store.

We're told the D.A. is looking at several issues.  The main one ... did Lindsay have an intent to steal when she left the jewelry store with the $2,500 necklace.  Proving intent to steal is a central element of the crime.

We've learned the warrant was signed by Judge Katherine Mader at 3:45 PM Tuesday.  The LAPD was making plans to execute the warrant -- which authorized cops to search for the necklace at Lindsay's home in Venice, CA.

Sources connected with the Lindsay Lohan necklace caper tell TMZ ... they believe Lindsay was tipped off after the judge signed the search warrant yesterday ... and she returned the jewelry before her house could be raided.
                                                            

Law enforcement sources tell TMZ ... last week the owner of an L.A. store filed a police report, claiming a $2,500 necklace was stolen from her business. We're told the store surveillance video shows Lindsay in the store, wearing the necklace before it disappeared, although it's unclear if the video actually shows Lindsay walking out of the store with the jewelry.

Mind you, turning in stolen property doesn't make it right, so the owner can continue to press the case... so Lindsay -- who is still on probation -- is not out of the woods.
